Doctor, nurse sent to jail for medical negligence

In a case of death due to medical negligence, Tinsukia’s Additional Chief Judicial Magistrate Dr Chetana Khanikar has sentenced Dr Mamoni Dutta and nurse Bimala Dutta of the Lokapriya Gopinath Bordoloi Civil Hospital, Tinsukia, to rigorous imprisonment for two years and a fine of Rs 3,000 each.

The judgement also stated that under Section 428 of the CrPC, the period of detention already undergone by the accused during the investigation, inquiry and trial would be adjusted against the sentence.
In the case, a man named Pradip Kakoti was admitted to the LGB Civil Hospital on October 16, 2013 with symptoms of malaria and was administered saline by nurse Bimala Dutta. Attending physician Dr Mamoni Dutta advised the patient’s attendant to bring a Falcigo injection.

After a couple of hours, the patient died, and when Kakoti’s relatives came to take away the body, they noticed that the Falcigo injection vial was lying on the table unadministered.

During the trial, the prosecution examined nine witnesses, seven pieces of documentary evidence and two material exhibits.

According to a hospital source, after the death of the patient, Dr Mamoni Dutta resigned from her post and left for Jorhat.
