Mumbai High Court passes Vigitation right to father

The Mumbai High Court recently passed an order regarding a father’s right to visit his child in case of the child living under mother’s custody.

Justice Prakash Naik dismissed a plea of a woman last Friday, where the woman was seen challenging a session court order. To the woman’s judgment the hon’ble high court passed the order of a father’s Vigilance right to his child under the domestic Violence Act.

In her petition the woman had stated that a man had no right to the child’s custody under section 21 of the act for independent custody orders.

For a man, to gain custody of his child is possible only under the section 26 of the Hindu Martiage Act.

In contradiction to the plea, the husband said that he didn’t seek permanent custody of his child and he only sought Visitation rights to his child.
